WHAT PERSONAL INFORMATION DO WE COLLECT FROM THE PEOPLE THAT VISIT OUR ONLINE STORE? When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information or other details to help you with your experience.

If you are a Designer, in addition to the information above, South Loop Loft may collect the following information when you set-up and/or update your Designer page and/or profile:

  • Information about your business, such as the legal business name, business phone number, and business address, your Resale Certificate or a copy of your business license + your state's applicable Resale Form. 

  • Your Social Media Platform usernames and/or handles.

  • Your photo, biographical information, portfolio work, qualifications, licenses, specialties, and any other information you decide to share to your public profile.

WHEN DO WE COLLECT INFORMATION? We collect information from you when you register on our site, submit an application for a Trade Membership, place an order, subscribe to a newsletter, respond to a survey, fill out a form or enter information on our site.

HOW DO WE USE YOUR INFORMATION? We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

Depending on how you use South Loop Loft products and services, we use your personal information in the following instances:

  • To host and provide the Site and Marketplace, and perform our Services to you and other visitors/customers;

  • To deliver direct marketing communications regarding our products and services that we may think are of interest to you;

  • To ship and deliver Products you have purchased from us through the Site;

  • To conduct and administer a Promotion if you have chosen to participate;

  • To respond to your queries and requests, or otherwise communicate directly with you;

  • To detect any fraudulent or illegal activity against you, our other users, and/or South Loop Loft ;

  • To perform system maintenance and upgrades, and enable new features;

  • To enforce and/or protect our rights and the rights of others;

  • To comply with a legal or regulatory obligation (for example, keeping records of our sales for tax compliance); and

In addition, we may use Usage Information for the following purposes:

  • To compile statistics and analytics about your use of and interaction with South Loop Loft Services, including details about how and where South Loop Loft Service is accessed, how often you visit or use South Loop Loft Service, the date and time of your visits, your actions on the Site and/or Marketplace, and other similar traffic, usage, and trend data, which allow us to better understand the functionality of our Site and Marketplace on your device and gain insights about how South Loop Loft Service is used in order to improve your experience;

  • To gather important functionality, testing, and performance data about the Site and Marketplace, including performance data related to the Site, such as networking activity, CPU load, and resource usage, among other relevant data;

  • To moderate user behavior on the Site, such as protecting against fraud and other inappropriate activities;

  • To gather demographic information about our user base;

  • To provide you with notifications, recommendations, and information about specific Products and/or features of South Loop Loft Service and/or additional products, services, or features we believe may be of interest to you; and

Aside from disclosing your information to those of our personnel who are authorized to process the information in order to provide South Loop Loft Service and who are committed to confidentiality, we disclose your personal information only to the third parties as described below.

  1. Third-Party Service Providers/Sub-Processors
    We share personal information with third parties that provide services to us that help us in the operation, provision, administration and management of South Loop Loft Service (“Service Providers”), and to otherwise operate our business. Depending on how you use South Loop Loft Service, the following categories of third parties collect data on our behalf or receive personal information:

    • Hosting services providers,

    • Analytics providers,

    • Payment processing providers (currently Shopify Payments);

    • Shipping providers and carriers;

    • Merchants and/or vendors of the Products we make available through the Marketplace (but excluding Trade Vendors, which are not our Service Providers as described below);

    • Providers of our Delivery Services;

    • Advertising and marketing partners,

    • Providers of business operations and communication tools,

    • Other third-party service providers that help us provide features and functions for South Loop Loft Service (e.g., customer support providers), and

    • Professional service providers, such as auditors, lawyers, consultants, accountants and insurers.

Business Transfers

Affiliates and Subsidiaries
Personal information that we collect may be shared with the employees, contractors, and agents of South Loop Loft and our affiliated and subsidiary entities (“Affiliates”) who are involved in providing or improving South Loop Loft Service and/or other products and/or services that we offer. We obligate the employees, contractors and agents of South Loop Loft and our Affiliates to ensure the security and confidentiality of your personal information and to act on that personal information only in a manner consistent with this Privacy Notice.

Legal Obligations and Security
Regulatory and Government Bodies – Compliance with Law
We may disclose your information to regulatory agencies and official government bodies, as required to comply with or satisfy any laws, rules, or regulations applicable to South Loop Loft .

Required Disclosures – Responding to Legal Orders
If we are required to disclose personal information by law, such as pursuant to a subpoena, warrant or other judicial or administrative order, our policy is to respond to requests that are properly issued by law enforcement within the United States. Under such circumstances, unless prohibited by applicable law, we will attempt to provide you with prior notice that a request for your personal information has been made in order to give you an opportunity to object to the disclosure. We will attempt to provide this notice by email, if you have given us an email address. However, government requests may include a court-granted non-disclosure order, which prohibits us from giving notice to the affected individual. In cases where we receive a non-disclosure order, we will notify you when it has expired or once we are authorized to do so.

Exigent Circumstances & Enforcement/Protection of Our Rights
Your information, including the contents of all of your online communications in our Services and between you and South Loop Loft may be accessed and monitored as needed to provide our Services and may be disclosed to law enforcement, regulatory agencies, official government bodies, and other third parties, as we, in our sole discretion, believe necessary or appropriate:

  • To enforce our rights under our Terms of Service (including, any applicable Additional Terms, guidelines, policies, and/or rules incorporated or referenced therein), and/or other agreements, terms, and/or policies we enter into with our users, customers, clients, and/or Designers and/or that are applicable to the use of South Loop Loft;

  • In connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity or activity that may expose us or our affiliates, partners and/or agents to legal liability; and/or

  • If we receive information that provides us with a good faith belief that there is an exigent emergency involving the danger of death or serious physical injury to a person.

With your Consent
There may be situations where you are asked to consent to share personal information with third parties for additional reasons not included in this Privacy Notice. In such event, we will only share such personal information if we have received your prior consent and only for the purposes as listed in the request to share such information.

Payment and Transaction Information

In certain circumstances, we may collect certain payment information, such as your credit card, bank account information, when you purchase any Products, Commissions or  Delivery Services, or if you are Designer, your taxpayer identification information (e.g., your employer identification number or social security number).

Note that we do not directly collect or store any payment and/or billing information. Payment transaction information is processed through our third-party PCI-compliant payment processors (currently, Shopify Payments ), on our behalf in order to collect fees payable by you in connection with any Services, Consultations and/or Products purchased by you.

The information provided to South Loop Loft only includes partial payment or credit card information, and limited transaction information via our payment processors’ portals. Please review the following Privacy Policies of our current payment providers to learn more about how they collect, process and protect your personal information:


HOW DO WE PROTECT VISITOR INFORMATION? We do not use vulnerability scanning and/or scanning to PCI standards. We do not use Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider and are not stored or processed on our servers.

DO WE USE ‘COOKIES’? Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

We use cookies to:

This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

THIRD PARTY LINKS: Occasionally, at our discretion, we may include or offer third party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

On or through the Site, we provide third-party “share” buttons which enable you to share certain content via social media sites (e.g., Facebook, Twitter, Instagram, YouTube, and LinkedIn). These “share” buttons may function as web beacons when you interact with the button. Please note that when you “share” using the buttons, you may send to the third party provider of the “share” button the information that you are viewing. If you are not logged into your account with the third party provider, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with the Site to your account with the applicable third party provider. Please refer to each third party’s privacy policies to learn more about its data practices.


CALIFORNIA ONLINE PRIVACY PROTECTION ACT: CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

ACCORDING TO CALOPPA WE AGREE TO THE FOLLOWING: Users can visit our site anonymously. Once this privacy policy is created, we will add a link to it on our home page, or at a minimum on the first significant page after entering our website. California Privacy Rights - Shine the Light

California residents who have provided us with personal information have the right (under California Civil Code§ 1798.83) to request and obtain from us, once each year, the details of any personal information we shared with a third party for that third party’s direct marketing purposes during the prior calendar year. The details would include the categories of personal information and the names and addresses of the third party with which it was shared.

To request information about this sharing, you may submit a request with "Your California Privacy Rights" in the subject line, along with your first and last name, and complete mailing address (including street address, city, state, and zip code) by either: sending an email message or writing to us at the email and/or mailing address specified in the Contact Us Section.

If you do not submit and send your request with complete information as set forth above, we will not be able to process it.


Nevada Privacy Rights

Under Nevada law, certain Nevada residents may opt out of the sale of covered personal information (which includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online) to a person for that person to license or sell such information to additional persons.

South Loop Loft does not currently sell your covered information as defined under applicable Nevada law; however, you may submit an opt-out request, which we will honor as required by Nevada law should we engage in such a sale in the future.

You may submit an opt-out request by sending an email message or writing to us at the email and/or mailing address specified in the Contact Us section; along with your full name, any user name, and complete mailing address (including street address, city, state, and zip code), email address (so that we can contact you, if needed, in connection with the request) and confirmation that you are a Nevada resident.

You must provide us with information reasonably requested by us to verify your identity and the authenticity of the request. We typically process these requests within 60 days from the day we receive it (and will notify you within that period if we need an additional 30 days to do so).


International Transfers

South Loop Loft is based in the United States. The personal information that we collect are sent to and stored on servers located in the United States. Such storage is necessary in order to process the information. South Loop Loft may transfer the personal data that we collect from you to our other offices and/or to the third parties mentioned in the circumstances described above, which may be situated outside of your country or regional area, and may be processed by staff operating outside of your country or regional area. In particular, information provided to us or collected by us likely will be transferred to and processed in the United States by us or our Affiliates and our respective agents and contractors.


In such a case personal data of a User in the European Union is transferred, we transfer your personal data with appropriate safeguards in place to protect your personal data, such as standard contract clauses or binding internal company rules. Regardless of the country in which your personal data is processed, the Controller takes reasonable technical, legal and organizational measures to ensure that the level of protection is the same as in the European Union, United Kingdom, and the European Economic Area.


HOW DOES OUR SITE HANDLE DO NOT TRACK SIGNALS? We honor do not track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

DOES OUR SITE ALLOW THIRD PARTY BEHAVIORAL TRACKING? It’s also important to note that we do not allow third party behavioral tracking

COPPA (CHILDREN ONLINE PRIVACY PROTECTION ACT): When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under 13.

FAIR INFORMATION PRACTICES: The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

IN ORDER TO BE IN LINE WITH FAIR INFORMATION PRACTICES WE WILL TAKE THE FOLLOWING RESPONSIVE ACTION, SHOULD A DATA BREACH OCCUR: We will notify the users via email within 7 business days. We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

CAN-SPAM ACT: The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.

  • Process orders and to send information and updates pertaining to orders.

  • We may also send you additional information related to your product and/or service.

  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CAN-SPAM we agree to the following:

  • NOT use false, or misleading subjects or email addresses.

South Loop Loft  Inc. (“South Loop Loft ”, “we”, “our,” or “us”) provides a mobile message service through which we (or others on our behalf) deliver certain service-related communications and marketing and promotion communications (the "Text Service"). Use of the Text Service is governed by these Text Service terms and conditions (these “Text Service T&Cs”). These Text Service T&Cs are incorporated into and a part of South Loop Loft ’s Terms and Conditions. . These Text Service T&Cs will control over any conflicting terms in our Terms of Service but solely with respect to the subject matter covered herein. Capitalized terms used herein but not defined will have the meanings given in our Terms of Service 

1. Changes these Text Service T&Cs

We may modify, suspend, or cancel the Text Service or any of its features, at any time, with or without notice. To the extent permitted by applicable law, South Loop Loft  will not be liable to you or to any third party for any modification, suspension, or cancelation of the Text Service (or any part thereof).

In addition, we may also modify these Text Service T&Cs at any time. Except as stated below with respect to material changes, all modifications to these Text Service T&Cs will be effective from the day they are posted online at www.thesouthlooploft.com/If we make any material changes to these Text Service T&Cs, we will post a prominent notice of the changes on our website located athttps://southlooploft.com/policies/terms-of-service (the “Site”) and/or by sending a Message to your mobile number if you are currently opted-in to the Text Service at the time of the modification. If you opt-in to the Text Service, South Loop Loft , and our applicable service providers on our behalf, will send you notifications via OTT/SMS/MMS text messages (collectively, “Messages”) to provide you with service-related communications regarding your use of South Loop Loft  Service (e.g., order updates, account alerts, etc.), and/or promotional and or marketing communications (e.g., cart reminders, special offers, discounts, price drops, etc. Please note that once you opt-in, you are agreeing to, and will, receive Messages from and on behalf of South Loop Loft  through your wireless provider to the mobile number you provided to sign-up for the Text Service, even if your mobile number is registered on any state or federal Do Not Call list. Messages may be sent using an automatic telephone dialing system (“Auto-dialer”) or other similar technology; provided that, the foregoing shall not be interpreted to suggest or imply that any or all of our Messages are sent using an Auto-dialer or similar technology.

Any personally identifiable information provided by you in connection with the Text Service shall be used only for the purposes of providing you the Text Service and as described in our Privacy Notice.

Participation in the Text Service is optional and consent to receive Messages from us is not required to use our Site, South Loop Loft  Service, Consultations and/or to purchase any Products.

You agree that you will not use the Text Service for any illegal or unlawful purposes.

The number of Messages that you receive as part of the Text Service will vary depending on your activity and your communication with South Loop Loft .

We do not charge for the Text Service, however, communications via text messaging may make use of the data network operated by your telephone, internet and/or wireless service provider to send both text messages and/or data, and you expressly acknowledge and agree that you, and not us, are solely responsible for any fees or charges incurred in connection with your receipt and/or sending of any Messages in connection with your use of the Text Service, including, without limitation, any telephone and/or mobile phone provider charges for SMS/MMS, text, or data usage or services, and/or any service charges for the use of any OTT messaging services. 3. How to Opt-In and Opt-Out of the Text Service

You must affirmatively consent to opt-in to the Text Service through an online registration from (e.g., by submitting your phone number for the express purpose of signing up for the Text Service, or clicking a box to expressly opt-in to the Text Service during account registration or when submitted a purchase order). BY OPTING IN TO THE TEXT SERVICE, YOU EXPRESSLY AGREE AND CONSENT TO RECEIVE MESSAGES (INCLUDING, BUT NOT LIMITED TO MARKETING AND PROMOTIONAL MESSAGES) FROM US AND OTHERS TEXTING ON OUR BEHALF, INCLUDING TEXT MESSAGES MADE WITH AN AUTO-DIALER OR SIMILAR TECHNOLOGY, AT THE TELEPHONE NUMBER(S) YOU PROVIDE TO US AT THE TIME OF OPT-IN (OR ANY SUBSEQUENT NUMBER YOU PROVIDE TO US TO RECEIVE MESSAGES AS PART OF THE TEXT SERVICE). IF YOU DO NOT CONSENT TO RECEIVE TEXT MESSAGES UNDER THE TEXT SERVICE, INCLUDING TEXT MESSAGES MADE WITH AN AUTO-DIALER, DO NOT OPT-IN TO THE TEXT SERVICE.

You may opt-out of the Text Service at any time by texting the single keyword command STOP to the number from which you are receiving the applicable Messages or, where available, clicking the unsubscribe link in the applicable Message. You'll receive a one-time opt-out confirmation Message, after which, no further Messages will be sent to your mobile device, unless initiate respond to any previous Message or re-opt-in to the Text Service. If you have subscribed to other South Loop Loft  Inc. mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective Text Service T&Cs.

4. Changes to the Text Service

We may change any short code or telephone number we use to operate the Text Service at any time and will notify you of these changes. You acknowledge that any Messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such Messages.

In addition, we may modify, suspend, or cancel the Text Service or any of its features, at any time, with or without notice. To the extent permitted by applicable law, South Loop Loft  will not be liable to you or to any third party for any modification, suspension, or cancelation of the Text Service (or any part thereof).

6. Duty to Inform and Indemnify

You certify, warrant and represent that (a) the telephone and/or mobile numbers that you have provided to us are your numbers and not someone else's, and (b) you are permitted to receive Messages at each mobile and/or phone number provided. You are responsible for notifying South Loop Loft  immediately if you change your mobile telephone number by contacting us at info@thesouthlooploft.com. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO INDEMNIFY South Loop Loft  IN FULL FOR ALL CLAIMS, EXPENSES, AND DAMAGES, INCLUDING, BUT NOT LIMITED TO, ALL CLAIMS, EXPENSES, AND DAMAGES RELATED TO OR ARISING UNDER THE TELEPHONE CONSUMER PROTECTION ACT, RELATED TO OR ARISING FROM AND/OR CAUSED BY, IN WHOLE OR IN PART, YOUR BREACH OF ANY THE FOREGOING REPRESENTATIONS AND WARRANTIES AND/OR OBLIGATIONS TO NOTIFY South Loop Loft  IF YOU CHANGE YOUR TELEPHONE NUMBER.

7. Access or Delivery to Mobile Network is Not Guaranteed

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions, including, without limitation, lapse or termination of your mobile telephone service and/or messaging service, failures in network services, prohibitions or restriction by carriers and/or service providers of certain mobile and/or messaging features, and/or incompatibility of certain mobile and/or messaging features with your carrier or mobile device and/or messaging service. You understand and acknowledge that the effective delivery and transmission of Messages is outside of South Loop Loft ’s control, and, to the extent permitted by applicable law, you agree that we will not be responsible or liable for any failed, delayed, or misdirected delivery, or receipt by you, of the Messages (including, without limitation, any issues arising from the circumstances above) and/or of any information sent through the Text Service, any errors in such information, and/or any action you may or may not take in reliance on the information or the Text Service.
